Brad concentrates his practice on commercial litigation, debt collection, and creditors’ rights. While pursuing his J.D., he was a clerk for Magistrate Judge Mary Milloy at the U.S. District Court for the Southern District of Texas. Brad dedicates himself to not only recognizing the clients’ immediate litigation needs but to achieving a desired outcome that is practical and consistent with their long-term objectives.

Commercial Litigation

  • Defended a Fortune 500 company in a complex lawsuit brought by a municipality alleging breach of contract, fraud, and breach of fiduciary duty. Managed extensive document preservation and e-discovery and the drafting of pleadings and motions. Obtained a favorable settlement.
  • Represented one of the largest full-service solid waste collection providers in North America in multi-state litigation against competitor for tortious interference with customers across the United States, including extensive e-discovery and motion practice. Obtained favorable settlement.
  • Defended Fortune 500 company against allegations of human trafficking and RICO violations concerning overseas government contracts and contractors, including large-scale e-discovery and extensive motion practice. Assisted in obtaining dismissal on jurisdictional grounds.
  • Represented a software company in complex commercial arbitration. Spearheaded extensive discovery necessary to refute fraud, breach of contract, and misrepresentation counterclaims. Obtained a favorable arbitration verdict awarding full damages.
  • Represented owners of venture-backed e-commerce company specializing in collecting and monetizing user behavior and information in enforcement and contempt action by Federal Trade Commission.
  • Defended oil and gas company in a breach of contract case concerning the enforceability of a take or pay provision in a buy-sell agreement. Obtained summary judgment and a favorable settlement.
  • Defended energy company in a dispute concerning a joint operating agreement and major cost overruns in the construction of a processing facility.
  • Represented energy company in a trial involving the purchase and delivery of drilling equipment, including co-authoring successful petition for review highlighted in Texas Lawyer “Appellate Lawyer of the Week.”
  • Defended hundreds of National Flood Insurance Program coverage lawsuits in state and federal courts throughout Texas.

 

Debt Collection and Creditors’ Rights

  • Represented secured creditor in the Kal Freight Inc. chapter 11 cases related to the eventual sale of a large trucking company and its affiliated businesses.
  • Represented creditors in the Zachry Holdings, Inc. chapter 11 cases related to the Golden Pass LNG export terminal project in Sabine Pass, Texas.
  • Represented personal injury creditors in the Steward Health Care System LLC chapter 11 cases, one of the largest private, physician-owned for-profit healthcare network in the United States.
  • Represented secured creditor in the Oklahoma Forge, Inc. chapter 11 case in the liquidation of a regional forging operation in Tulsa, Oklahoma.
  • Represented energy, infrastructure, and engineering recruitment company in a suit on a sworn account and breach of contract matter. Obtained summary judgment and collected nearly 100% of actual damages post-judgment.

 

Employment, Noncompete, and Trade Secrets

  • Represented a medical device manufacturer against a competitor and former employee alleging theft of trade secrets and breach of non-compete and confidentiality agreements.
  • Represented turbine manufacturer in a lawsuit against a competitor and former employees alleging theft of trade secrets.
  • Represented a medical billing service company in a lawsuit for theft of trade secrets and tortious interference with non-compete and non-solicitation agreements.
  • Defended healthcare company in an employment dispute alleging theft of trade secrets and breach of non-compete and non-solicitation agreements.
