Matt’s practice focuses on litigation involving business and contract disputes, real estate (including landlord/tenant matters and construction claims), civil appeals, and shareholder/partnership disputes. He has over a decade of experience representing parties in litigation in state and federal courts at the trial and appellate levels.

Business Litigation

  • Represents parties in a wide range of business and commercial disputes, including shareholder/partner/member disputes, breach of contract, fiduciary duty litigation, and trade secrets and non-compete litigation.
  • First chair in all litigation phases, including case assessment, pre-trial matters, motion practice, discovery, trial, and appeal.
  • Obtained numerous summary judgments disposing of cases or awarding judgment without the need for trial.
  • Provides advice and counsel to minority and majority shareholders related to records inspections, claims analysis, and derivative proceedings.
  • Negotiates business divorces through buy-outs.

Civil Appeals

  • Represents clients in various appellate cases before the Courts of Appeals and Texas Supreme Court.
  • Obtianed affirmation of a dismissal of a contending claim in property forfeiture proceeding.
  • Obtianed affirmation of an interlocutory order denying a motion to dismiss regarding a defamation counterclaim.
  • Obtained reversal and remand on appeal of an order dismissing a case based on an arbitration clause.
  • Obtained reversal and render of a judgment regarding adverse possession client had lost on at trial.

Real Estate Litigation

  • Represents owners, landlords, buyers, sellers, general contractors, and subcontractors in various claims and disputes, including landlord-tenant disputes, construction defects, removal of liens, and Uniform Fraudulent Transfers Act cases.
  • Represents a number of commercial landlords in disputes with tenants.
  • Provides advice, counsel and representation to goods and services providers and commercial landlords regarding statutory lien laws.

Construction Litigation

  • Obtained multi-million dollar settlement in case involving remediation services at an apartment complex following the Great Texas Freeze of 2021.
  • Represents materials and service providers in filing of materialmen’s liens.
  • Represents commercial landlords in the removal of materialmen’s liens.

Business Divorce and Shareholder Disputes

  • Obtained buy-out of a minority interest in an oil and gas company during the course of litigation at fair value.
  • Negotiated and obtained a reverse buy-out (minority gets the company) for minority shareholder of a computer systems support company during the course of litigation.
